2. Definitions
Provider: Refers to RestoLastMinute SRL, managing the website www.restolastminute.com. Restaurateur: Refers to any customer with private rights over a Restaurant listed on www.restolastminute.com and subscribed to the Provider. User: Refers to any user who contacts a Restaurateur, makes a request, books a Listed Restaurant and may use it thereafter. Restaurant: Refers to any restaurant offered for booking with a promotional deal by its Restaurateur on the Provider's site. Site: Provider website accessible at www.restolastminute.com.
3. Purpose
The Provider's objective is to offer a search engine where Restaurateurs can, as part of their business activity and against financial contribution, create a page for their restaurant and offer Users deals and discounts on cover reservations. This search engine also allows Users to choose among Listed Restaurants and obtain all necessary information. The Site is free for Users but paid for Restaurateurs through subscription or a fixed fee per reserved cover. Legal conformity guarantee: The legal conformity guarantee for digital services applies for the entire duration of the service delivery.
4. General terms of use of the site for Users and Restaurateurs
The Provider offers Users an information society service consisting in hosting listings related to Listed Restaurants. As such, the Provider acts as a hosting provider under Directive 2000/31/EC and cannot be held responsible for information stored at users' request. Although the Provider strives to make the RestoLastMinute.com site available 24/7, it reserves the right, at any time and without prior notice, to interrupt access for technical or other reasons and/or to terminate its services, without being liable for such interruptions and resulting consequences for any User or third party. The Provider reserves the unilateral right to suspend access to all or part of the site for any natural or legal person breaching these terms.
5. Specific terms for Restaurateurs
Restaurateurs can pay subscriptions to the Provider via the following payment methods: • Secure online payment via Stripe • SEPA direct debit At contract expiry, the Restaurateur keeps access to their Restaurateur Area where they can renew or deactivate their contract.
6. Privacy
When creating an account, the User is asked to provide information such as first name, last name, email address and phone number. By accepting the site's privacy policy, the User accepts that personal data be stored in a database (used solely by the Provider) for sending communications and offers by email. The User expressly consents to receiving commercial information by electronic means from the Provider for the purpose of promoting its services. The User may opt out at any time via the objection procedure mentioned in each commercial email.
7. Miscellaneous provisions
Certain rules stated herein may conflict with the laws of the country from which advertisers access the RestoLastMinute Site. These terms are governed by Belgian law and advertisers accept the exclusive jurisdiction of the courts of Namur for any dispute related to these terms.
